OUR GENERAL TERMS AND CONDITIONS
§ 1 Scope, customer information
The following General Terms and Conditions regulate the contractual relationship between Manapan GmbH and the consumer and companies who sell goods through our online shop. Conflicting or deviating terms and conditions from our General Terms and Conditions shall not be recognized by us. The contractual language shall be German.
§ 2 Conclusion of contract
1. Offers in the Internet represent a non-binding request for you to purchase goods.
2. After you have entered your data, and by clicking on the order button, you will submit a binding transaction for a purchase agreement. You can also issue binding orders by telephone.
3. We are entitled to accept bids issued via the Internet within 3 working days upon sending an order confirmation by email. After the period of time mentioned in clause 1 has elapsed fruitlessly, your offer bid shall be deemed as denied, i.e. you are no longer obligated to honour your quotation. With telephone orders, your purchase order shall materialise, if your offer is accepted by us straight away. If the offer is not accepted immediately, you are no longer obligated to honour it.
§ 3 Customer information: Saving your order data
We shall save your order with details of the contract closed between us (e.g. type of product, price, etc.). You have no access via the Internet, however, to your previous orders. The AGB will be sent to you; you may also recall the AGB at any time via our website. If you wish to save the product description on our Shopping Page for your own purposes, you can make a screenshot of the order, for example, at the time the order is made (= photo of the screen), or alternatively print out the entire page.
§ 4 Customer information: Corrections
You can correct your entry details before the goods are ordered at any time using the cancel button. We will inform you by means of further correction options through the ordering process. You are also able to completely end the ordering process at any time by closing the browser window.
§ 5 Return consignment costs in case of cancellation
You have to bear the costs of returning goods in case of cancellation, if the delivered goods correspond to the goods ordered and, if the price of the goods to be returned does not exceed 40.00 EUR, or if in case of a higher price of the object at the time of the cancellation you have not yet rendered a service in return, or made a contractually agreed part payment. You also have to bear the regular costs of the return consignment. Additional costs, which may arise e.g. through a change of our business location or arise through the use of expensive transport services we have selected, shall be at our expense.
§ 6 Retention of title
The object of purchase shall remain our property until complete payment has been made.
§ 7 Warranty
The warranty shall be in accordance with the legal provisions.
§ 8 Place of commercial jurisdiction
The sole place of jurisdiction for all disputes arising from this contract shall be our place of business, if you are a merchant.
